Liability Waiver

Version 2026-10-06

1. The parties

This waiver is between you, the person creating a Lot account (and, if you are signing up a lab, the lab you are signing up on its behalf) - the “Releasor” - and Lot, the organization that operates the App (the “Releasee”). It takes effect the moment you check the box accepting it at signup, and applies for as long as your account is active.

2. The activity

This waiver applies to your use of Lot: a chemical inventory record-keeping tool that photographs containers, extracts label fields, and surfaces hazard-related information gathered from third-party sources (such as PubChem) or entered by your own lab members.

3. Assumption of risk

You understand that working with chemicals carries inherent risk, including personal injury, illness, fire, and property damage - risk that exists independent of whether or how Lot is used, and that Lot does not create, remove, or certify against. You further understand and agree that:

  • Lot is a record-keeping aid, not a certified safety system. It does not perform regulatory compliance verification and is not a substitute for your institution's own chemical hygiene plan, hazard communication program, or EHS office.
  • Chemical names, grades, hazard pictograms, NFPA ratings, CAS numbers, and every other field Lot extracts from a photo or resolves against a third-party chemical registry are produced by automated processes and may be incomplete, outdated, or incorrect - including a value Lot displays with no source attached, and including a value it displays as confirmed. A blank or “not enough data” result means Lot has not verified something, not that nothing hazardous is present.
  • Decisions about how a chemical is stored, handled, labeled, transported, or disposed of remain your lab's own responsibility at all times, to be made under your institution's own safety policies and the judgment of trained lab personnel, not by relying on anything Lot displays. Storage-suitability mismatches, expired-item flags, and compliance dashboard results are aids for finding things to check, not a certification that anything is safe or compliant.

You choose to use Lot voluntarily and assume these risks.

4. Release and waiver

Having read and understood the above, you forever release and discharge Lot, to the fullest extent permitted by law, from any and all claims, lawsuits, or demands arising out of injury, loss, or damage caused by ordinary negligence or by your or your lab's use of Lot - including, specifically, any reliance on chemical, hazard, or storage-suitability information Lot displays, or any chemical handling, storage, transport, or disposal decision made by you or your lab. This release does not extend to gross negligence, willful misconduct, or any liability that cannot be waived under applicable law.

5. Changes to this waiver

This waiver may be updated from time to time. A material change will be reflected in a new version date at the top of this page, and a new signup will be asked to accept the current version.
